Second Creekview Teacher Charged With Sexual Assault

Matthew Tamanini is alleged to have carried out an inappropriate sexual relationship with a 16-year-old Creekview student.

 

A Creekview High School drama and English teacher has been arrested and charged with two counts of sexual assault following allegations that he conducted a sexual relationship with a student.

Matthew Tamanini, 31, of Canton, allegedly had the affair with the 16-year-old student over a four month period, according to the Cherokee Sheriff's Office. The Sheriff's Office believes at least two sexual assaults occurred on the Creekview campus itself.

These assaults on campus caused the Sheriff's Office to charge Tamanini with two counts of sexual assault against a person in custody.

According to the Cherokee County School District, Creekview High School Principal Adrian Thomas was notified of the relationship on Tuesday and alerted the district's police department. Superintendent Dr. Frank R. Petruzielo authorized an internal investigation, which allowed school police to inform the Sheriff's Office about the misconduct. The Sheriff's Office began their investigation Wednesday morning.

Tamanini was hired by the school district to teach at Creekview in May, 2007. Tamanini is currently being held at the Cherokee Adult Detention Center without bond and is scheduled to go before a magistrate judge Wednesday. 

This is the second such incident involving a Creekview High School teacher in the past two months; on Nov. 28, 2012, special education teacher Blake Bearden was arrested for allegedly conducting a three month long sexual relationship with a 17-year-old student.

I realize that the men are wrong for these relationships, but when does the responsibility of these girls actions fall on them. They can do and accuse, but they are old enough to know what they are doing!!!!!!!!!!! What are they doing to the girls? Are they being punished at school. If they were having sex with another student at school they would be suspended or worse expelled from school. Parents let their children dress revealing and think men and boys aren't going to look. The actions of the girls should be looked at as well. Where are the parents???? How would this happen at school???????? I am tired of having all the blame put on the boys and men!!! When do the girls take responsibility?????? Parents should of sensed something was going on. I'm sure ill get a lot of angry responses, but the girls have some responsibility in this. If they are old enough to drive and work, they know how to say No!

We can not place blame on the victim of crime. Students must be safe in school and never preyed upon, no matter what. My problem is with girls who make up such stories and ruin the lives of good teachers. I have no facts in this particular case but am saddened by it and honestly do not believe it. Why are teachers not considered innocent until proven guilty?

I personally don't feel that it is a "boy/girl" issue, I feel that it is an "adult/child" issue. How would you feel if it were your teenage daughter and her teacher? Would you feel differently if it were your teenage son? I feel the adult is in control and it is the adults responsibility to make the appropriate decision. A 16 year old changes his/her mind about "the love of their life" as often as they change their "BFF"...Just my opinion though.

Personally I'll await more detail before I access fault. At least beyond 'as an adult he/she should not allow this to happen'. Do find it curious that 'assault' and 'relationship' are included in the description. A glaring clue that this might be a bit more complicated than one person acting alone. And indicative that something might be possible to assist adults to behave as adults and children to enjoy their childhood as kids before they are encouraged to act like whatever image of adulthood which exists for a teenager.

I believe that the law is the law! He is an adult having A sexual relationship with a minor. This means that he does the crime and pays the time if found guilty. He is in a leadership position and is using it for his personal sexual gain.

Googled. It turns out there have been two reported incidents, one in November and this one from two different teachers. There are some folks (in original comments) who are actually debating responsibility between the teacher vs. the student. I can not believe that in the 21st century there is still that much ignorance in our society. I don't care how old the student was/boy or girl/the adult is the responsible party. IF a student tries to begin an inappropriate relationship with an adult, it is the adult's responsibility to say "NO" and find that student professional help. It is NOT a proper response for an adult to ever consider an inappropriate invitation from a student.

Recently in a Cobb school, a girl lied and nearly ruined a guidance counselor's life. She recanted on the witness stand, said he was going to call her mother about her grades, so she lied to stop him. He is now having to sue the state board of education to have his license reinstated. He was innocent of all charges. Perhaps you saw it on the news. I'm just asking that we not condemn anyone at this point.

I was a teacher and got caught with an underage student. Her and I have been married for over ten years now and have two kids. I received First Offenders and I don't even have a criminal record anymore. While on probation I earned three Master's Degrees, and I'm now a successful part of society again. Although I don't agree, my wife will tell you it was her fault. All I know is that she was the most beautiful thing I had ever seen, and to this day, I've never met a more beautiful person. She made my heart hurt when I saw her.....and I'm not exaggerating.

I can tell you anything you want to know about the absolute hell this guy is about to experience and do so publicly. The media will rip him apart just like me and everything they report will be 75% wrong. I finally, after many years learned that it's not the media or the court papers that define me. I'm not embarrassed or ashamed. I wouldn't even change anything about my life. It's made me what I am, and I'm a good man and a great father. Even more than that....I'm happy.

Just me - Awe, happy to help. It's been a long road but now makes for interesting conversation for people who don't know us. I was twenty four then, and I think too young to teach. I could write a book about the experience.....it would probably open some eyes. I really didn't have any idea that I could get in that kind of trouble. Initially, I faced 55 years in prison. It still makes me sick to say it.

Honestly their both to blame and if little girls think it's fun to act like for lack of a better word "slutty" and carry on a relationship with older men then they must have major daddy issues and their parents are to blame. Everyone now a days blames the adult in the situation but I've been to school with girls like this and they can ruin reputations student or teacher.. All this to basically boil down to its both of their faults and creekview as well as other high schools in the area need to watch who there hiring. They also need to have a strict meeting with the school staff and students about the matters that have came up in the past 2 months.

to Former Teacher: The law changed a couple years ago and it's not her age that's the issue as 16 is the law of consent in GA; it is the fact that sexual contact between a teacher and student in Georgia is now a felony punishable with 10-25 years in jail, even if it were found to be consensual. It is called sexual assault because the teacher is considered to have custody/control of the student. Your situation was different because the law was different back then. Bottom line though, we do not know the facts yet, not even if he is guilty as charged.

KW - The laws have not changed. The only thing that changed is the guidelines regarding the sex offender registry. Let's face it though...the sex offender registry is a joke.you have 18 year-olds on it who were caught having sex with their underage girlfriends. This guy has a Sexual Assault charge which means it's not age related. His is likely because he was on a position of authority.

Former Teacher: Actualy the law *did* change in 2010 to remove what was viewed as a loophole. Ga legislators specifically wanted the consensual defense taken away in cases between teachers and students, because it was used by the state Supreme Court to overturn some convictions. just one of many online reports http://www.11alive.com/news/article/212393/3/LITHIA-SPRINGS-Teacher-arrested-under-new-Ga-law-banning-sex-with-students. The law applies to schools up through 12th grade and states "A person who has supervisory or disciplinary authority over another individual commits sexual assault when that person: (1) Is a teacher, principal, assistant principal, or other administrator of any school and engages in sexual contact with such other individual who the actor knew or should have known is enrolled at the same school;[snip] Consent of the victim shall not be a defense to a prosecution under this Code section"

We don't need to over-react as we don't know all of the facts. The teacher could be a predator. The student could be the aggressor. The two could be "in love". The teacher may not have been the student's teacher. So much to know.

That said, the age of consent in Georgia is too low! Basically, Georgia is inviting adults to engage in sex with 16 and 17 year old kids when that same 16 year old isn't old enough to:

1. Have an abortion without her parent's consent.
2. Drive a car unless he/she remains in school and attends a driver safety course.
3. Buy a beer.

The age of consent needs to be raised. That way, any adult engaging in relations with a 16 or 17 year old would risk jail. Any current prohibition of teacher/student relationships is subject to being deemed unconstitutional as has been the case in other states.

As a parent of a Creekview student, I am OUTRAGED over this! "This is the second such incident involving a Creekview High School teacher in the past two months;".

Really?

Exactly what has been done since the last incident to prevent this from happening again? ( Whatever it was, it didn't work!) Where is the principal? Where is the great Dr. P? Haven't heard anything except from that condescending form letter attached to this news story!

Why?

To protect the Cherokee County school system's reputation. They'll try to keep this as quiet as possible until no one cares anymore and it all just goes away.

Guess what?

That's not OKAY with me Mr. Superintendent and Mr. Principal!! Why has this happened twice in the past 2 months? Who is in control over there at Creekview?

Demand answers parents!

High school students are NOT adults! They're CHILDREN. Teachers need to stop blurring the line between those two things; ie, students calling a teacher by a nickname or just their last name with no Mr. or Mrs. in front of it! I know Matt Tamanini's students call him "T", just like they would one of their friends. That diminishes the adult's authority!

To the parents of the girl involved in this CRIME, I'm with you 100%. Your daughter is NOT to blame. Some comments above have insinuated her to be "slutty" and an "aggressor". I don't care if your daughter was standing naked in front of "T", it was HIS responsibility as a teacher and an ADULT to NOT cross the line.

To any student reading this, there IS a line. It is NEVER okay for an adult to cross it with you. EVER! That's why it's a CRIME. You're worth more than that, and YOU DESERVE BETTER!

It is my responsibility as a parent to protect my children and guide them in their ways. I EXPECT THE SAME FROM THE ADULTS THEY COME IN CONTACT WITH WHILE THEY'RE AT SCHOOL! I expect PROFESSIONALISM just like I would anywhere else!

My kids don't need more FRIENDS. They NEED adults who make an impression on them to be adults that command respect by their words and actions, especially in the classroom!

I am a personal friend of the family involved. I would like to thank you for the kind words. This girl is not a floozy or someone who flashes herself around school. She is a very intelligent girl with a huge heart who is going through hell in this ordeal. To those of you who have shown your support, thank you. To those of you who have blamed her and said awful things, I pray for you. That you never experience a situation like this with your child and have to read the awful things people say about her based upon a few lines in a newspaper.

Agreed on all points. It was the teacher's/adult's job to hold the line. This teacher blurred many boundary lines between teacher and students and became their friend, long before this incident. I hope admin can find a way going forward to regularly remind staff at CHS of the need to maintain authority boundaries while not jeopardizing good communication and mentoring with students nor creating an atmosphere of paranoia where teachers are too afraid to show any kindness or personal warmth toward a student. To my knowledge they already conduct something like this at least annually.

Shame on you FORMER TEACHER for your comments above. Students will be reading this, and the issue at hand gets lost. The SERIOUSNESS of a teacher, and I use that term lightly in this case, taking advantage of the vulnerability of a young girl is UNACCEPTABLE in every sense of the word!

To any teachers reading my posts, please understand, I am not attacking your profession. I'm attacking a total lack of control at Creekview, and I'm sure this isn't the only school where teacher/student "relationships" are occurring.

To all the good and decent teachers out there, and my kids have been very blessed with some wonderful teachers, I commend you! You should be outraged by this, as well. YOU DESERVE BETTER, TOO!

Yes, KW, the state mandates that teachers watch a video every year about these issues. It doesn't mean everyone will comply. As a former teacher, I liked having the reminder to be careful. I always left the door opened when I was alone with a student. It's time for cameras in the classroom, not just the halls. They are used in daycare centers for everyone's protection. Why not in public schools?
